The most affected people here are the innocent and common people who are unaware of the basics of Law and Order, even the educated crowd is not aware of the same.
Crimes are increasing these days and the victim due to unawareness of the Law and order are not coming forward and reporting. According to National Crime Report Bureau (NCRB), 70%cases are not reported out of fear and lack of awareness.
The first thing the Victim has to do is to be aware and updated with law and order. The second most important thing is to go and File First Information Report (FIR)




WHAT IS FIRST INFORMATION REPORT (FIR)???

First of all, filing a complaint is a fundamental right of every citizen.
First Information Report is the foremost and the first step in a criminal case that helps the Investigation Officer (IO) or Police Officer (PO) to know the basics of the crime like the location of the crime, time of the crime committed, name of the victim. Who can Lodge a First Information Report???


A First Information Report can be filed by anyone, a Victim, an eye witness, or the person with the best knowledge of the crime.

STEPS TO FILE A FIRST INFORMATION REPORT

Rush to the nearest police station, describe every detailed information you know about the crime.
You can either verbally tell the officer about the incident, like what happened, where it happened, what time and how it happened or you can yourself write down the same.

If the detail is given verbally by you then it is the duty of the investigating officer (IO) or Police Officer (PO) to write it down and also has to make an entry in general dairy or daily diary.

If you submit a written copy, then you must carry 2 copies, one for the duty officer and one for self.
The officer will go with all the details, once you handover the copy of the information, the officer will read it out for you.

You need to sign the copy or the First Information Report once the police have filed the complaint. Sign the First Information Report after verifying the details that the officer has filed is as per your details or not.
A copy of the First Information Report will be given to you with FIR Number, date of FIR, Name of the police station.
Make sure the copies are stamped and the stamp bears a DD number or Daily Dairy Number.

CAN A POLICE OFFICER REFUSE TO FILE A FIRST INFORMATION REPORT?


NO, THE POLICE OFFICER HAS NO RIGHT TO REFUSE FILING A FIRST INFORMATION REPORT.

WHAT CAN BE DONE IF THE POLICE OFFICER REFUSES TO FILE FIRST INFORMATION REPORT?
First of all, you can meet the high post officer like Deputy Inspector of General Police (DGP) and bring the complaint into his notice.
You can send your complaint in writing to the superintendent of the police if he is satisfied with the complaint, he will investigate the same.
You can also file a private complaint in the jurisdiction.
You can contact the Human Rights Commission if the police are not doing anything in a biased manner.
Refusal of filing of the First Information Report is a punishable offense under the Indian Penal Code, 1860.
