Everyone today is well known with social media platform; social media platform has become a topmost platform where the number of the crowd is communicated within a matter of a click, no matter what the distance is.

Social media has also become a platform for various other things like education and business. The growing crowd is using social media as a platform to carry out various business activities like the purchase and sale of goods. But were using social media platforms on a large number is trending there the trust of the customer may get low. Consumers are facing a lot of problems while dealing with e-commerce portals.

CONSUMER PROTECTION ACT

Consumer Protection Act was established in the year 1986 to give certain rights to the consumer. Later looking at the large usage of the social media platform for the business the act was amended in the year 2019 i.e. last year it aims in the earliest and timely settlements of disputes between the consumer and the dealer.
Change of era in the technology era, CPA(Consumer Protection Act 2019) included e-commerce platforms in its act.


DEFINITIONS

In the old act i.e. Consumer Protection Act 1986, the consumer was a person who dealt with the various business of purchase and sells offline, whereas the new amended act of 2019 provides a completely new definition and remedy to the consumers dealing in multitasking or level marketing.

What does the act exclude?

The act excludes the services that are provided free. Telecom services are included.



E-COMMERCE

 E-Commerce is an online platform where the goods are sold and purchased online through the electronic network. Still, the offshore e-commerce business is not cleared in this act.

WHAT DOES THE ACT INCLUDE?

ØThe act includes Unfair Contract, to protect the consumer from the unreasonable contract in favor of manufacturer and service providers.

Ø  Unfair trade practices to protect the consumer from misleading an advertisement that refuse to take back the defective goods and refund within 30 days

Ø  The complaints will be decided within 21 days.

Ø  The act has made the government create a Consumer Disputes Redressal  Commission.

Ø  The manufacturer will be completely liable even if they prove them are not fraudulent in making a way warranty product.

ADVANTAGES OF THE ACT

·        The complainant can file a case in its territorial area i.e. he/she can file a complaint in the area where he/she resides or works, which will relieve his/her travel burden.

·        The limit of the case filing of the product of total 1Crore from 20Lakhs for district Commission and up to 10crore from 1crore for state commission and National Commission for above 10crore.
·        The act has an advantage of written consent by both parties as mediation.

·        The act has given a facility of E-complaint facility before the district forums with rules prescribed by the government.

CONCLUSION

The amended act has given a new ray of hope to the new era of technology and away relief to consumers to file the complaints in a very easy and smooth way.
