RAISE VOICE NOT HATE
Love, hate, freedom, gesture are the words
that affect our life very much. Even if a single love word or speech is uttered
our whole imagination and perspective towards the person changes and we feel so
happy.
Today the world of people is surrounded by
social media even a small happy moment or the mood swings are updated on social
media. Heated arguments, politics, and economic causes are in trend.
But these
days instead of love speech the hate speech is increasing day by day, whereas
the Indian constitution has given freedom of speech as a part of the fundamental
right. Freedom of speech and expression is at most important.
There is a thin line between freedom of
speech and expression which if crossed causes hate speech. The laws towards
these are made so that the line is maintained but despite that, the numbers of
cases of hate speech are increasing day by day.
To change the cases of hate speech it is
very necessary to change the legal framework, whereas there is less awareness
about it.
Today the nation and the youth are more
interested in politics and social views. Defaming each other has become a new
trend and a weapon to humiliate each other mostly through social media.
Each and everyone today at every next
moment faces hate emotion, the hate speech is gaining its popularity, social
media is the most loved and used media to share and spread the news.
I remember the case of Delhi city where
just a small argument about the parking was turned to be the best way to harm
the reputation of the other one, now a day it has become a new trend to do so.
According to the reports the year 2018 was
declared as the ERA OF ONLINE HATE where lots of cases were reported of online
hate.
The speech may be intentionally or unintentionally
if harms someone’s reputations are termed as hate speech. There are some
restrictions imposed on freedom of speech and expression.
1.
The freedom of speech and the expression should be restricted where the question of security of the state arises.
2.
No one should violate the
relation of India and foreign countries if done so will be treated as a crime
under article 19(2).
3.
No words should contempt the decorum of the court prohibited under the freedom of speech and expression.
4.
To speech should be uttered
that will commit an offense.
5.
No person should defame an
individual or the organization should be prohibited.
The hate of speech is a criminal offense under the Indian Penal Code.
1.
Discrimination, racism on
grounds of religion, caste, birth, residence, and language falls under section
153A.
2.
When the hate speech
affects national integration it falls under section 153B.
3.
Hate speech that outrages
or intends the feeling of religious beliefs falls under section 295A.
4.
Uttering words that affect
the religious beliefs of the person fall under section298
5.
Spreading of rumors,
hatred statements causing ill effects between classes falls between section
501(1) and (2).
Facebook that is very popular social media among the people
also, have guidelines to prevent hate speech, stated that any content that
spreads hated speech will be removed.
The government
also says that the details of the users will be found out within 24 hours and
strict action will be taken against the person.
Recently a judgment was passed that there should be some
restrictions imposed on the freedom of speech and expression in case of the youtube

We all are aware of the Delhi riots in the year 2020 when some leaders
came forward and said things to spread hatred among the youth and which
directly gave birth anger, which resulted in the loss of many lives. This
proves that hate speech not only affects single people but also
innocent people are affected by it.
This topic has been the most debated in public and lots
of amendments are made due to it.
If we talk about the hatred of emotion, it has wide content
as the entire world is connected through social media. Different countries have
different cases based on hatred speech.
A bill was passed by the government proposing a code of
conduct. In September 2015 the honorable Supreme Court struck down the section
66A of Information Technology Act 2000, saying that it affects the freedom of
speech.
Right to freedom and Expression was given to keep the
opinions on the table whereas the speech was misused and turned hatred which
disturbed the peace of the nation.
The Human Rights in its 24th report
restricted freedom of speech on the grounds of the following cases:
1.
Child pornography
2.
Community hate
3.
Protection of one’s reputation
4.
Forcing to commit the offense
5.
Creating violence on National
racial or religious grounds.
The hate speech can be folded differently
so it becomes difficult to recognize it. It has become a worldwide problem; due
to the excess connection of social media, it has reached every part of society.
To avoid all the problems the communication
should be transparent, we should understand that raising voice is essential not
the hate.
