date it has extended to Lockdown 4.
Many of
the people along with health issues are facing a financial crisis, looking at
this tough situation the honorable Prime Minister Mr. Narendra Modi along with
Home Minster issued notifications to the companies for payment of salaries and
wages without any deduction, the obligation to which strict action is to be taken.
On
April 14 on the announcement of an extension of Lockdown 2, honorable Prime
Minister Mr. Modi made a statement to all the employers to be kind towards
their employees. Still every now and then new flashes in front of the eyes or
the ears, that XYZ companies terminated services of their employees, they have
announced salary cuts.
We are
well aware of the tough situation that Aviation, media, hospitability, banking,
and financial sectors are the worst-hit sectors.
Legal
experts are trying best to bring out the change in terms of employment during
such a situation, which constructed it as an offense.
Many of
the employers are handing over the resignations to the employees, to which the
employees agree, rather than taking it legal as of fear that it would hurt
their future job prospectus.
Fears
of job loss during this lockdown situation, employees are forced to work on
salary cuts or low salaries too.
As per
the statistics list of public complaints received has increased in one month of
lockdown. Nearly 72,000 complaints are received out of which 20,000 complaints
are received by PMO.
This is
the time to maintain a balance between business and cost.
Examples:
200 fellow workers in Jaipur factory were shockingly informed about business
shut down and will be paid only when the lockdown will finish. This created an
environment of stress for their basic needs and survival.
Several
companies have made the employees sign a blank paper in case of half wages for
March; wherein later they came to know that it was for their resignation
letters.
Luckily,
it’s not unusual for the Indian economy. The reality cannot be denied that
wages and salaries are the only sources for many people to survive.
Many of
the companies are forcing the employees to re-join the work as in to get the
salaries, without any safety majors, ignorance to which they are threatened to
resign from the job. The pandemic of Covid19 cases is increasing in this
situation the employees fear joining the offices and the employers taking work
from home are still not paying the salaries.
Looking
at the situation, a petition was filed in Supreme Court where the 3 bench judges
decided to examine the situation and, on the 29th March, the order was issued by
the Government of India to private and public sectors not to terminate the jobs
or to cut salaries. It was also observed in a petition that many Private
companies taking advantage of deadlock situations illegally are deducting
salaries and terminating the services, which is a complete breach and violation
of the law.
The
Supreme Court is in the view to take strict action against such companies’
employers for violation of the law under Article 21 of the Indian Constitution.
