MOTHERHOOD MY HAPPINESS AND MY RIGHT



Pregnancy is an important part of married life. Being an independent country, today many of the women are working independently in several fields like medical, law, politics and many are working in the corporate world.

75% of women today are married and working, they are handling the responsibility at the domestic and professional level. Marriage is an essential part of life, as soon a woman gets married, going in motherhood is expected from her and its wonderful feeling.

The question arises when the woman is working in the private sector and needs maternity leave but at times she feels shy to ask for the same, but as per law getting and asking for maternity leave is compulsory for private sectors under Maternity Benefit Act,1961.
Today every other woman is working in Public or Private sectors where Indian Constitution says that she is eligible to take paid leave when she is expecting a child.

Various laws including parental laws are becoming a part of the debate in India, mostly between Employees and Employers.

In the Private sector out of hesitation and fear of losing job women do not ask for the leave. According to Madras High Court asking and granting maternity leave to women is her fundamental right and it should be included in the service period only.



Maternity Benefit Act 1961, says that a woman who is expecting must get 26 weeks paid leave as pre and post-birth for child care. Maternity Benefit Act 1961 has given certain benefits under its guidance :

  • Maternity Leave: increased from 12 weeks to 26 weeks (applicable to women who are expecting 1st or 2nd child). 12 weeks leave for the women expecting a child for the third time.

  • Adoption Leave: Maternity Benefit Act 1961 amended itself and gave benefits to the adopted mother to take 12 weeks to leave from the date of adoption of the child.

  • Work From Home: another benefit added to the Maternity Benefit Act 1961, women after her expiry of maternity leave can adopt an option of Work From Home if she wishes so.

Expecting women have full right to ask for maternity leave, she can at the workplace until that can avoid standing works for long hours, and also she can work in sections.

Maternity Benefit Act 1961, amended in the year 2017 and brought complete new and comfortable benefits for women. It included all the organizations that have more than 10 employees before amendment maternity leave was only for 3 months now it has been extended to 6 months, however, it is a paid leave in India.

The Maternity Policy must be known and understood by women while joining the job.
If any company is found with denial of Maternity Leave strict action will be taken against such companies.

If any women’s service is terminated due to the leave because she is expecting has full right to file a complaint against such company in labour court under the Maternity Benefit Act 1961, the company employer will be punished with 3 months imprisonment, fine or both fine may extend to Rs 5000.
Remember maternity leave is a fundamental right of women under the Maternity Act 1961.
